Merrick Beginning in March 2021, Brian Garland, an American lawyer and judge, will take over as the 86th attorney general of the United States. He was born on November 13, 1952. From 1997 until 2021, he presided as a circuit judge for the District of Columbia Circuit of the United States Court of Appeals. Garland started working as a private attorney at the Arnold & Porter law firm in 1981, as the Carter administration came to an end. Garland was made a partner in 1985 and focused primarily on corporate disputes. Garland represented an insurance firm in the case Motor Vehicles Manufacturers Assn v. State Farm Mutual Automobile Insurance Co, which sought to reinstate the unpopular automatic seat belt requirement. Garland wrote an eighty-seven-page article for the Harvard Law Review after the case was successfully appealed to the Supreme Court and the District of Columbia Circuit Court, outlining how courts apply a stricter “hard look” standard of review and scope of review when an agency decides to de-regulate, with a greater emphasis on the actions of the agency’s being faithful to congressional intent.  Garland lectured at Harvard Law School in 1985–1986 while working for Arnold & Porter and teaching antitrust law. He also wrote a piece for the Yale Law Journal proposing the inclusion of state and municipal governments in the antitrust immunity framework.

Garland joined the U.S. Attorney’s Office for the District of Columbia in 1989 as an Assistant United States Attorney because he wanted to get back into the public sector and handle more trial work. Garland worked as a line prosecutor for the government in criminal cases including anything from drug trafficking to intricate public corruption investigations. Garland was one of the three main prosecutors in charge of looking into Mayor of Washington, D.C. Marion Barry’s cocaine possession.

Garland then worked there from 1992 to 1993 before making a brief return to Arnold & Porter. As a deputy assistant attorney general in the Criminal Division of the US Department of Justice, Garland joined the Clinton administration in 1993.  The next year, Garland was requested to serve as Jamie Gorelick’s main associate deputy attorney general by Gorelick, who had been a significant mentor to Garland. Garland’s duties in that capacity included managing high-profile domestic terrorist cases, such as those involving the explosions in Oklahoma City, Ted Kaczynski, and the Atlanta Olympics.

After the attack, Garland insisted on being dispatched to Oklahoma City to see the crime scene and direct the investigation in order to gather evidence for the prosecution. At the preliminary hearings for the two principal defendants, Timothy McVeigh and Terry Nichols, he spoke on behalf of the government. Garland offered to be the team’s leader but was unable to do so since he had a commitment at the Justice Department’s main office. Instead, he assisted in selecting the squad and oversaw it from Washington, D.C., where he participated in important choices including the decision to pursue the death sentence for McVeigh and Nichols.  Frank Keating, the Republican governor of Oklahoma, praised Garland’s work on the case.

Garland attended Niles West High School in Skokie, Illinois, where he participated in theatre performances, served as president of the student council, and competed on the debate team. He graduated in 1970 with the highest grade in his class. Garland was also a National Merit Scholar and a Presidential Scholar. Garland attended Harvard University to study social studies after high school. He first intended to become a doctor, but soon changed his mind and opted to become a lawyer. When Garland was chosen as the sole freshman representative on a campus-wide committee that Gorelick was also a member of, he sided with his future boss.

Garland volunteered to compose speeches for Congressman Abner J. Mikva over the course of his college summers. Mikva relied on Garland to hire law clerks when Jimmy Carter assigned Mikva to the D.C. Circuit. While a student at Harvard, Garland worked as a Quincy House tutor and contributed news and theatre reviews to the Harvard Crimson. Garland researched business mergers in Britain during the 1960s for his 235-page honours thesis. Garland earned an A.B. summa cum laude from Harvard in 1974 and was inducted into Phi Beta Kappa.

Garland later enrolled in Harvard Law School, where he was a Harvard Law Review member. Garland unsuccessfully sought the Law Review’s presidency; as a result, he worked as an articles editor. Susan Estrich won the election.  Garland was assigned to edit a contribution by U.S. Supreme Court Justice William Brennan on the subject of how state constitutions protect individual rights as an article editor.[20] Later on, this correspondence with Brennan helped him secure a clerkship with the court.  Garland received his Juris Doctor magna cum laude from Harvard Law in 1977.
